The contracting authority did not qualify Elisa Eesti AS because in the contracting authority&#8217;s opinion the tender did not meet the conditions set by the contracting authority for the submitted reference contracts. Elisa Eesti AS challenged the decision of the contracting authority, finding that the decision of the contracting authority was not in accordance with the positions expressed in long-term administrative and court practice, legal literature and policy-making guidelines. The dispute involved various legal aspects of public procurements in relation to the assessment of the performance of reference contracts in the case of the provision of a fixed-term service. The Public Procurement Review Committee dismissed the appeal of Elisa Eesti AS.
