The dispute concerned the liability of the road builder in a situation where the contracting authority wishes to build a road with different types of pavement offered by the contractor and the contracting authority later finds that the type of pavement he has ordered does not meet his wishes. The Supreme Court annulled the judgment of the circuit court by which PKM Grupp O\u00dc was responsible for the situation.
