It is not reasonable only in exceptional cases, such as in case of a hurricane or other natural disaster.<\/p>\n\n\n\n<p>In the civil case of the Supreme Court, the plaintiff was a limited\nliability company EUROPARK ESTONIA. The defendant had parked in the parking\narea of plaintiff and had failed to pay 11 parking penalties according to the\napplication. The owner of the parking area announced a contractual penalty\nevery time, leaving the notice under the windshield wiper of defendant\u2019s car,\nbut according to the defendant, the defendant did not receive any fines. Thus,\nthe parking lot manager and the owner of the vehicle argued if leaving the fine\nnotice on the vehicle\u2019s windscreen was a reasonable way to transmit it.<\/p>\n\n\n\n<p>The County Court satisfied the action of the private limited company\nEUROPARK ESTONIA. Tallinn Circuit Court did not agree with the County Court&#8217;s\ndecision and annulled it. The Circuit Court argued that leaving a fine notice under\nthe windshield wiper was not a reasonable way to notify, since the plaintiff\nwho was the owner of the parking area was aware of both the responsible vehicle\noperator and his contact details.<\/p>\n\n\n\n<p>The Supreme Court&#8217;s Civil Chamber decided that this way of filing a fine\nnotice can be considered reasonable. It is not reasonable only in exceptional\ncases, such as in the case of a hurricane or other natural disaster.
